A jury found that a railway company and train conductor weren't to blame for a fatal collision with a pickup truck. In 2007, Rudolph Chavez Sr., 45, and his son, Rudolph Chavez Jr., 22, were struck by a Kansas City Southern Railway Company train as they were driving across railroad tracks in Aguilares. Both men died from injuries sustained in the crash. Their family blamed KCSRC and conductor Jose Juarez, alleging the train was speeding and the crew failed to sound the horn, keep a proper lookout, and apply the brakes in a timely manner. The defense argued Chavez Sr. had a duty to yield when the train came into view, and the crew couldn't have slowed in time to avoid the collision. The jury determined that Chavez Sr. was 100 percent responsible for the accident.
