A jury awarded nearly $61 million to a 6–year–old boy who suffers brain damage that was alleged to be an injury that occurred during his birth. The boy's parents, Bruce and Mary Swanson, alleged that the delivering obstetrician took far too long — about nine minutes — to free an impacted shoulder, thereby allowing the fetus to sustain asphyxia. The Swansons also claimed that the obstruction stemmed from a nurse's decision to commence the pushing process before the obstetrician had arrived in the delivery room. The child, Michael Swanson, suffered developmental delays that are expected to necessitate years of therapy and custodial care. The defendants argued that Michael's injury occurred long before his birth, but the jury found otherwise.
