A jury awarded $485,000 to a 4-year-old child who suffered mild palsy as a result of an injury that occurred during birth. The suit was filed on behalf of Jayden Bennet, who suffered Erb's palsy of his right arm during the first two years of his life. The condition limited the arm's strength and mobility. Jayden's mother, Lizzette Cain, claimed that the palsy was a result of traction that was applied to the boy's head during his delivery, to relieve entrapment of his right shoulder. She claimed that a Caesarean delivery would have been safer, given the child's size, but that the delivering obstetrician miscalculated the fetus's weight and performed a vaginal delivery. The obstetrician denied having erred, but the jury found otherwise.
