
A jury awarded a little more than $3 million to a worker who was burned in a flash fire. In 2008, Alvaro Chavez, then 52, used his cigarette lighter to check the fuel gauge on a logging loader and was engulfed in flames. Chavez blamed Gardner Oil for using gasoline-contaminated fuel instead of pure diesel fuel. Handling pure diesel is very different than handling gasoline because diesel cannot cause a flash fire. Gardner contended that it delivered pure diesel and that the flash fire was probably caused by a gasoline tank that was in the back of the truck. Chavez sustained second-degree burns to his face, neck and hands.
