In 2007, Cathy Guillory, then 37, was at the checkout of a Kroger store in Katy when a bag slipped while the clerk was handing it to her. She bent over to prevent the bag from falling, leaning one hand on a credit card machine. The stand gave way, and Guillory fell to the floor. She claimed the screws had been missing from the stand for at least a week and the store was aware. Guillory claimed a chondromalacia patella in her left knee, requiring arthroscopic debridement. The jury found Guillory 49 percent liable and Kroger 51 percent liable, which reduced the $132,100 award.

Applebees Settles Over Slip and Fall On Hump In Floor Resulting In Injury - Dallas, Texas

 

An Applebee's restaurant agreed to pay $935,000 to a woman who tripped and fell on a hump in the floor. In 2007, Deborah Scofield, then 29, fractured her foot in the fall and injured her knee, which both required surgery. More than a year and a half after the fall she had lower back pain. An MRI showed disc extrusion at L5-S1. She underwent a hemilaminectomy and discectomy. The defense argued that a subsequent incident caused the back injury. The parties settled on the eve of trial.

Worker Who Slipped and Fell And Injured Knees Recovers At Trial - Dallas, Texaws

 

 

A jury awarded more than $4 million to a worker who tore a knee after slipping on ice at a construction site. The suit's plaintiff, Hassan Shabazz, 37 at the time of the December 2002 incident, claimed that the site's tenant, the site's owner and the project's contractors failed to adequately clear a sidewalk. He ultimately underwent replacement of the knee that was injured, and he contended that additional surgery will be necessary. He claimed that he cannot resume physical labor and that his sedentary work options are limited. The defendants contended that Shabazz's injuries were the result of degenerative conditions, but the jury found otherwise and awarded damages of $4,175,341.28.

Resident Wins At Trial For Slip and Fall At Apartment Building

A jury awarded $1 million to a woman who fell down four stairs outside her apartment because the loose handrail allegedly detached. In 2007, Margo Nickerson, then 32, claimed that she sustained cervical and lumbar disc herniations in the fall. She claimed that the 4-foot-long wooden handrail wasn't properly bolted to the stairs. She claimed that she previously complained to the property manager about the handrail, but he didn't do anything. She underwent a cervical fusion and a lumbar discectomy.

Customer's Slip and Fall In Store Results In Plaintiff's Verdict

A jury awarded $856,855 to a man who claimed he sustained severe back injuries when he fell in a grocery store. Candelario Becerril bumped against the chrome rail separating the check-out lines as he was shopping at a Brookshire's grocery store in Pittsburg back in 2006. The rail collapsed, sending him to the floor. He said he sustained lumbar disc injuries. A year later, he underwent a laminectomy, discectomy and fusion surgery, but he said he continues to need pain medication and epidural injections. Becerril sued Brookshire's, alleging the store failed to properly maintain and inspect the area where he fell. Brookshire's argued Becerril's injuries were caused by an on-the-job accident a few years earlier. 

 

Railroad Engineer Who Slip and Fell Gets Verdict

 

A railroad engineer who was injured when he slipped while disembarking from a train recovered $444,582 in a lawsuit against BNSF Railway Co. In 2006, Jacob Justus, then 28, slipped on 2- to 4-inch ballast rocks (which were laid down to support railway ties and rails) and sustained a labral tear in his hip. He underwent arthroscopic surgery, and his doctor said Justus might need a second surgery in the future. Justus was unable work for a year, and when he returned it was at a job that paid less than the engineer position. Justus sued BNSF, his employer and the owner of the train tracks, alleging it failed to provide a safe workplace and that the ballast rocks at that location should've been smaller. BNSF argued that the area was safe and that Justus should've been more careful getting off the train. The jury found both parties negligent, with BNSF 55 percent and Justus 45 percent liable.

Salesman Gets $450,000 For Slip and Fall

 

On Jan. 16, a salesman received a $450,000 settlement for knee injuries he sustained when he slipped and fell on a freshly mopped floor. In 2007, Omar Escamilla was working at the Micro Center store in Houston when he slipped, fracturing his patella in four places. Just prior to the incident, the floor was mopped by an employee of Jani-King of Houston, which is contracted to perform cleaning services at the store. Escamilla alleged the Jani-King employee failed to put out signs or other warnings that the floor was wet. Escamilla, who had recently completed a degree in law enforcement, said he is no longer able to pursue a career as a police officer because the injury limited his mobility. He sought $654,000 in future lost wages. Jani-King denied liability and disputed the lost wages claim.

Slip and Fall Nets $128,423 Verdict

 

A woman who fractured her ankle when she tripped and fell on a senior center exit ramp won $128,423 in a jury trial. In 2007, Sharron Faye West, 48, was leaving the Kirbyville Senior Center via the ramp when she fell, breaking her right ankle in two places. Doctors placed two metal plates in her ankle, but her recovery has been slow due to diabetes and preexisting conditions in her feet and legs. Her podiatrist opined that West will eventually need ankle fusion surgery and her right foot may have to be amputated. West sued the senior center, alleging the ramp was unfit for use. She noted multiple problems including missing wood, raised nails, an uneven surface and a steep slope. The senior center argued the ramp was safe and contended that West was responsible for her fall. The jury found West's damages totaled $185,577, but her net award was reduced due to the jury's finding that she was 25 percent at fault.
